1. Introduction

ODELA respects the intellectual property rights of businesses, users, content creators, photographers, trademark owners, and other rights holders.

This Copyright & Intellectual Property Policy explains the standards applicable to content published or submitted through ODELA, operated by Odela Technologies.

Users must not upload, publish, reproduce, or distribute content through ODELA unless they have the necessary rights, licences, permissions, or other lawful authority to do so.

2. ODELA Intellectual Property

Unless otherwise stated, intellectual property owned by or licensed to Odela Technologies may include:

  • ODELA name and branding
  • ODELA logo
  • Website design elements
  • Original graphics
  • Original written content
  • Software and source code
  • Platform functionality
  • Databases and compilations where protected
  • Promotional materials
  • Other original ODELA content

These materials may be protected under applicable copyright, trademark, and other intellectual property laws.

3. Permitted Use of ODELA

Users may access ODELA for legitimate personal and business-discovery purposes in accordance with our Terms & Conditions.

Unless authorized, users must not:

  • Copy substantial portions of ODELA
  • Republish ODELA content commercially
  • Reproduce ODELA branding deceptively
  • Modify and redistribute protected ODELA materials
  • Sell ODELA content
  • Create unauthorized copies of the platform
  • Use ODELA intellectual property to impersonate Odela Technologies
  • Remove copyright or proprietary notices
  • Use ODELA trademarks in a misleading manner

4. Business-Submitted Content

Business owners and authorized representatives may submit content such as:

  • Business logos
  • Photos
  • Menus
  • Product images
  • Business descriptions
  • Promotional graphics
  • Videos
  • Offers
  • Other business materials

By submitting such content, you represent that you have appropriate rights or authorization to use and publish it.

5. User-Submitted Content

Users may be able to upload:

  • Review photos
  • Reviews
  • Comments
  • Business information
  • Other user-generated content

Users remain responsible for ensuring their submissions do not infringe another person’s intellectual property rights.

6. Licence to ODELA

When you submit content for publication on ODELA, you grant Odela Technologies a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, resize, distribute, and otherwise use that content as reasonably necessary to operate, promote, secure, and improve the ODELA platform.

This licence does not transfer ownership of your intellectual property to Odela Technologies.

You should not submit content if you do not have sufficient authority to grant the permissions required for ODELA to display and operate it.

7. Restaurant Menus

Restaurants or authorized representatives may upload menus to their business profiles.

The person submitting a menu must have appropriate authority to publish it.

Menus may include trademarks, photographs, descriptions, pricing, and other materials belonging to the relevant business or other rights holders.

ODELA does not claim ownership of a restaurant’s original menu merely because it is displayed on the platform.

8. Business Logos and Trademarks

Business names, logos, trademarks, and brand identifiers displayed on ODELA generally remain the property of their respective owners.

Displaying a third-party business name or logo for legitimate identification or directory purposes does not mean that Odela Technologies claims ownership of that mark.

It also does not necessarily imply sponsorship or endorsement by the trademark owner.

9. Photographs

Do not upload photographs that you copied from another website, photographer, social media account, competitor, or other source unless you have appropriate permission or another lawful right to use them.

ODELA may remove photographs following a valid intellectual property complaint.

10. Prohibited Intellectual Property Use

Users must not knowingly:

  • Upload copyrighted content without authorization
  • Copy another restaurant’s menu or photos improperly
  • Use another business’s logo to impersonate it
  • Upload pirated material
  • Remove ownership or copyright notices
  • Sell unauthorized copies of protected content
  • Misrepresent ownership of content
  • Use ODELA to facilitate intellectual property infringement

11. Copyright Complaints

If you believe content available on ODELA infringes copyright that you own or are authorized to enforce, you may submit a complaint to ODELA.

Please provide sufficient information for us to identify and evaluate the content.

12. Information to Include in a Copyright Complaint

A copyright complaint should generally include:

  • Your full name
  • Email address
  • Phone number, where appropriate
  • Identification of the copyrighted work
  • Identification of the allegedly infringing content
  • Exact ODELA URL where the content appears
  • Explanation of your rights in the original work
  • Supporting information demonstrating ownership or authorization where appropriate
  • A statement explaining why you believe the use is unauthorized
  • A good-faith declaration that the information provided is accurate

Additional information may be requested where reasonably necessary.

13. Trademark Complaints

If you believe an ODELA listing or other content improperly uses your trademark, provide:

  • Trademark owner’s name
  • Trademark or brand involved
  • Registration information, if applicable
  • ODELA URL containing the disputed material
  • Explanation of the alleged infringement
  • Your relationship to the trademark owner
  • Relevant supporting documentation

Not every use of a trademark constitutes infringement. ODELA may review the context before taking action.

14. Copyright Infringement & Takedown

Detailed instructions for submitting an infringement complaint are available in our separate Copyright Infringement & Takedown Policy.

Rights holders should use that process when requesting removal of specific content.

15. ODELA Review Process

After receiving a sufficiently complete intellectual property complaint, ODELA may:

  1. Review the information provided.
  2. Request additional information.
  3. Identify the disputed content.
  4. Contact the person or business responsible for the content where appropriate.
  5. Restrict or remove content where reasonably warranted.
  6. Take other appropriate action consistent with applicable requirements.

Submitting a complaint does not automatically guarantee removal.

16. Counter Information

In appropriate circumstances, a user or business whose content has been removed may be permitted to provide information explaining why they believe they have authorization or a lawful basis to use the disputed material.

ODELA may consider information from both parties where appropriate.

17. False Claims

Do not knowingly submit false intellectual property complaints.

Fraudulent complaints, fabricated ownership claims, or misuse of the complaint process may result in account restrictions and other appropriate action.

18. Repeat Infringement

ODELA may restrict or terminate accounts that repeatedly or seriously infringe intellectual property rights.

The appropriate action will depend on the nature and circumstances of the violations.

19. Content Removal

ODELA may remove or restrict content when we reasonably believe:

  • A valid rights complaint has been submitted
  • The uploader lacks appropriate rights
  • Content violates applicable law
  • Content violates ODELA policies
  • Continued publication creates significant legal or platform risk

20. Third-Party Websites

ODELA may link to independent restaurant websites, social media pages, videos, or other external resources.

ODELA does not control all content published on third-party websites.

Intellectual property complaints concerning content hosted entirely by another service should generally be directed to the relevant third-party provider.

21. Reporting Unauthorized Use of ODELA Branding

If you discover a website, account, application, advertisement, or other party falsely representing itself as ODELA or improperly using ODELA branding, please report it to us.

Include:

  • URL or location of the content
  • Screenshots where available
  • Description of the issue
  • Any additional relevant information

22. No Transfer of Ownership

Uploading content to ODELA does not automatically transfer ownership of that content to Odela Technologies.

Rights remain with their respective owners, subject to the licences necessary for ODELA to host and display submitted content.

23. Policy Enforcement

Violations may result in:

  • Content removal
  • Listing modification
  • Feature restrictions
  • Removal of disputed media
  • Business listing restrictions
  • Account suspension
  • Account termination
  • Other appropriate action

24. Changes to This Policy

ODELA may update this Copyright & Intellectual Property Policy as the platform, services, or applicable legal requirements evolve.
